On June 30, 1990, SALDATE interviewed Debra Milke's sister, SANDY PICKINPAUGH. SANDY was pregnant and her father insisted that she tape record the interview with a view to not having to testify at the trial.

The interview lasted three hours; six days later, SALDATE would produce an eight-page 'narrative' report [in a suggestive contrast, Debra's half-hour interrogation yielded six-and-a-half pages of material]. The tape ran out about halfway through the interview. The forty-page verbatim transcript of the taped part of the interview corresponds to about the first three-and-a-half pages of SALDATE's summary. A comparison of SALDATE's report and the actual transcript shows some startling details.

After stating the time and place for the record, the interview begins. The transcript shows the interview properly began with :

Mr. Saldate: When was the last time you talked to your sister?
Sandy: My son's birthday, November 11th.
Mr. Saldate: November 11th of?
Sandy: '89
Mr. Saldate: Did she call you?
Sandy: Um-hmm.
Mr. Saldate: What did she have to say?
Sandy: Well, she called to wish Jason a happy birthday and also to tell me about the results of the hearing. I guess Mark had filed some kind of papers to try and get joint custody of Chris and she had just attended the hearing the previous week. And was really happy because the judge denied him joint custody and she just was really happy about it. Because he didn't get any part of the custody.

In SALDATE'S report, a completely invented remark attacking Debra's character was added to his version of the opening exchange: "Sandra said that the last time she spoke to her sister was on November 11, 1989. She said she called her to wish her son Jason a happy birthday. Sandra said this was strange because usually Debbie didn't think of anyone else and didn't really understand why Debra had called. During this conversation, Debra told her that a judge had denied joint custody to Mark at a recent court hearing."

SALDATE then began to talk with SANDY about her family. After talking about her mom and dad, the conversation touched on MARK and Debbie. Talking about her father's anger toward MARK, SANDY makes one of her few positive comments about her sister:

Sandy: They'd been at odds with each other -- typical, I think any father would probably react, not even talking about the murder, I mean. My sister is a very attractive person. She's very intelligent and my parents had a lot of aspirations for her, you know, a lot of plans for her, you know, and Debby did real well until my mom up and left...

This comment did not make it into SALDATE'S report at all. The interview had not yet produced anything more he deemed worth including. The transcript shows that after more discussion of the family history, SALDATE begins to discuss the murder with SANDY. Debbie had first met her roommate, JIM STYERS, a few years previously when he lived in the same apartment complex as SANDY. JIM and SANDY were friends. SANDY sensed that JIM was attracted to her. Her personal view of Debra and JIM'S friendship was formed by both personal knowledge and evident jealousy. She explains that she never saw any signs that things were not right with JIM in the weeks before the murder. This, she says, surprised her, as she and JIM were good friends. SALDATE then asks her about Debbie and JIM, and SANDY gives him something he can use :

Mr. Saldate: What was Debbie's position with Jim?
Sandy: Well, I (inaudible). She was never as close to him because my sister didn't have any friends. The only time she ever called people was when she needed something and she's always been that way. She does not have friends. She never had friends...
Debbie has never had any true friends to her name. It's just people that she's acquainted with that when she needed something then she calls then she calls them up (inaudible), you know, and Jim was one of those people...

So, about twenty minutes into the interview, SALDATE has finally gotten the first animadversion about Debbie. In his report, this comment is presented as immediately following the first-fictitious-criticism of Debra, and is contrived as the answer to a question that SALDATE never asked: "I then asked Sandy if she could tell me about any of Debra's friends. She immediately responded that Debra did not have friends. She explained that Debra will call upon people when she needs something but that they are not really her actual friends. She said that for the most part, she was getting Jim to do everything for her."

As a final touch, the last sentence of the paragraph above is badly misstated and far stronger than what was actually said.

The transcript shows that SALDATE now was able to prompt Sandy to start trashing her sister :

Mr. Saldate: Okay. This is the impression I got. Correct me if I'm wrong... I've talked to some people that knew Debra. They referred to her as very materialistic.
Sandy: She was.
Mr. Saldate: Would you believe--
Sandy: Oh, yes. Very materialistic, very, very selfish, self-seeking, self-centered. Very very vain. Conceited, I mean, just greatly conceited about herself as far as outward things like her appearance or things that wanted or pursued she got. She knew it early.

Good stuff, just what he is looking for. Only one small problem: the description was prompted by SALDATE - he fed Sandy the first adjective. But in writing his report this is no problem at all. He just presents Sandy's description as completely original:
"I then asked Sandra if she could describe her sister and she said she could. Sandra then said her sister was, in her words, materialistic, selfish, self-seeking, self-centered, vain and conceited. Sandra said this may sound as if she did not like her sister, however, that was not true. She said she loves her sister but that she has come to realize what her sister actually is and for the most part, she feels sorry for her."

The third sentence of this paragraph is almost completely made up. In the transcript, several minutes after the previous exchange there comes:

Mr. Saldate:... And I could sit here and look at you and I know this is difficult for you saying things but if someone else was to listen - or someone else (inaudible) that I'm on the opposite side. They would say well, Sandy must really hate her sister... That's not true though?
Sandy: No, it's not true.

This simple "no" answer to SALDATE'S leading question becomes SANDY'S "spontaneous" comment in the third sentence. The last sentence of the paragraph, "SANDY'S" explanation, is completely from SALDATE'S imagination.

This mainly invented statement, though, allows SALDATE a great deal of 'narrative flexibility.' In his report he can continue to misrepresent SANDY'S rambling responses to his leading questions as her spontaneous, coherent responses to simple and fair questions. Indeed, the next paragraph of SALDATE'S report begins
"I asked her if she could explain and she said Debra was an expert at manipulating people. Sandra said that she was her main target during that period of time because as Sandra described herself, she was easy."

These two sentences are simply invented by SALDATE to introduce the next two paragraphs, which are an "improved" - that is, inaccurate - summary of SANDY'S comments about Debbie, MARK and CHRIS. The second of these paragraphs contains yet another invented statement by SALDATE -
"I then asked her about the time Debra went to Colorado presumably to get her act straight. Sandra just chuckled and said that was a joke."

We are now near the bottom of page two of SALDATE'S report. The next-to-last paragraph there is SALDATE'S version of...

Mr. Saldate: Master of deception, master of -
Sandy: Yeah, master of deception to she's a master of manipulation... Debra has a way with people. She... makes people feel so sorry for her that they are going to do just about anything. And, I mean, right down to - I couldn't even put a limit in what they would do for her...

SALDATE'S restatement is :
"Sandra went on to say that her sister is a master of deception and manipulation and that she has a certain way with people. Debra can make anyone do what she wants them to, even though they may truly know Debra. Sandra then said 'There is no limit what a person would do for Debra.'"

SANDY did indeed make the first statement, although yet again SALDATE misrepresents it as spontaneous. The first part of the second sentence is misleading, making SANDY'S statement sound much more damning; the second part of that sentence is, unbelievably, still another product of SALDATE's 'narrative imagination.'

The last statement of this paragraph is especially noteworthy. At Debra Milke's trial, SALDATE explained that while his reports are "paraphrased narratives," the statements that appear there in quotes are, in fact, exact quotes-statements he is repeating with special attention to accuracy. Many of the "exact quotes" in SALDATE's record of Debra's "alleged confession" were very damaging. And, here, we have one of SANDY'S 'exact' quotes - though it is scarcely exact. It is yet another statement 'improved' by SALDATE to make it far more damaging to Debbie. SANDY'S musing that she - SANDY - can't think of the limits of what people would do for her sister turns into the condemnatory statement that SANDY knows that there are no limits to what someone would do for Debra.

As misleading and inaccurate as SALDATE's report has been already, we now reach his most outrageous lie. SALDATE is not just there to take SANDY'S statement - he has a definite goal. The claim at Debra Milke's trial will be that she convinced her roommate, JIM STYERS, to murder her son. By a combination of leading questions to a willing witness and deceptive renderings in his police report, SALDATE now has the 'facts' that Debra is manipulative and deceitful, has no real friends, and is just generally a bad person. The interview now reaches SANDY'S view of her sister's relationship with JIM. To explain how Debbie Milke can have JIM STYERS so much under her control that he would murder a child at her suggestion, SALDATE has a definite idea of sexual manipulation.

SALDATE begins to work on SANDY'S ill will toward her sister, in particular, her jealousy of Debbie's friendship with JIM. He mentions that JIM has been sending Debra lovelorn letters while they are both in prison. He suggests that perhaps there exists a letter from Debbie to JIM in which she promises to be with him when they both get out [ - there is in fact no such letter.]. This suggestion does catch SANDY'S fancy - yes, she says, that's how Debbie gets what she wants.

The time is ripe, SALDATE thinks. He offers SANDY an explicit idea of how Debra might sexually manipulate JIM :

Mr. Saldate:... And I'm sure (inaudible) maybe you can tell me. Like you said the gestures and things that she did (inaudible). But it would not surprise me if she would get up accidentally, you know, quickly run out her bedroom or something like that (inaudible) or be something --

Much to SALDATE's disappointment, no doubt, the idea of her sister 'accidentally' being seen in a revealing state doesn't really strike a chord with SANDY:

Sandy:... That's not Debbie. No.
(... )
Sandy:... Like I said we always did consider Jim such a close friend that he never looked at us in that respect, you know, a woman... You're talking about Jim and you've got to realize that Jim has always meant to us just like a father actually a surrogate father. We never thought about it.

Unable to get the desired response this way, SALDATE moves on to another tack. He suggests that during his interrogation of Debbie, she tried to seduce her way out of trouble by flashing her breasts at him :

Mr. Saldate:... So me and her talking and I'm telling her I'm not going to tolerate that. She's not going to do it. She - dress looked very nice. She wraps the front of her blouse and she pulls it up to her eyes, she didn't have no tears, to wipe her tears away but she didn't have any.
Sandy: (Inaudible)
Mr. Saldate: Which quickly exposed her (unintelligible). I didn't really pay that much attention to - I knew, you see, my job, in my position I knew what she was doing to me... But see, I'm there for information, okay. And she's like trying to see if I -
Sandy: It's working.
Mr. Saldate: It's working. If he's looking at my breasts then I may be able to talk myself out of this. Okay. So that's what I'm telling you. That's the type of manipulation she does. She loves that...

After Debra was arrested, KIRK FOWLER, court appointed investigator for the defense, had to pick up her clothing that she was wearing when she was arrested by SALDATE. From top to bottom, she had:

  • a bra,
  • a T-shirt and
  • a cardigan sweater,
  • panties and
  • blue jeans,
  • socks and
  • tennis shoes.
If Debbie were to expose her breasts she would have had to:
  • pull up her sweater, then
  • pull up her T-shirt (which was tucked into her blue jeans) and then
  • pull up her bra.
The mechanics of this operation, by the way, show that it is almost physically impossible.

But this prompting of SANDY still doesn't work. It only shifts her attention to how fascinating observing Debra has always been for her. So SALDATE has failed to get the statement he wants from SANDY portraying her sister as a soulless vamp. But - for him - this turns out to be no problem at all. In his official report, he just makes up the statement out of whole cloth, including an entirely fictitious 'exact quote' :
"... Jim went on to tell her that she was already doing it and taking advantage of her. I then asked Sandra why Jim would let her do this and Sandra replied that she was sure that Debbie would probably lead him on, tease him and pursue intimate thoughts with him. Sandra said she was sure that Debbie would never have slept with Jim but then said 'I'm sure she would have given (sic) him enough food for thought to make him do anything for her.'"

Not too long after this part of the interview the tape ran out, leaving SALDATE's 'narrative' as the only account of what happened during the rest of the interview. With both versions available on print as a part of the original court records (the transcript of the interrogation - half of it) and this report, SALDATE'S techniques in twisting statements, falsifying and fabricating allegations can be proven without a doubt. We expose the original report of SALDATE to the point where the tape ran out and the transcript ends. Until that point, direct comparisons can be made and discrepancies can be highlighted.

The report had entered Debra's trial and Levy referred to it, asking Sandra Pickinpaugh:

Mr. Levy: Do you recall being interviewed by Detective Armando Saldate in Wyoming?
Sandra Pickinpaugh: Yes, I do.
Mr. Levy: Have you reviewed his report in preparation for your testimony today?
Sandra Pickinpaugh: Yes, I have.
Mr. Levy: Did you find any errors or inaccuracies in his report?
Sandra Pickinpaugh: No, I didn't.
( ... )
Mr. Levy: And are your statements in here appear to be accurately so stated?
Sandra Pickinpaugh: Yes, they are.
Mr. Levy: What I meant was, does this appear to be like "Question, Mr. -- Detective Saldate; Answer, Sandra Pickenpaugh," that kind of format?
Sandra Pickinpaugh: No, it was more that he just took down what I said exactly.

But that's simply not true, because - looking at the report - we are able to uncover SALDATE's techniques in using various phrases made during an interrogation and putting them together with complete falsifications to make them appear the way he wanted things to look. It's the exact same way he did it with Debbie's alleged confession, which hardly anyone believes has taken place at all. But SANDY'S false testimony and SALDATE's lying report show something else : they confirm that SANDRA PICKINPAUGH was an unreliable, prejudiced witness who gave untrue testimony to get back at her sister Debra Milke. SALDATE's report was not what SANDY 'said exactly'; it was a falsified narrative of the interview twisted to make it say what SALDATE wanted it to say.

These proceedings resulted in another fatal assumption of the jury members: they were led to believe that SALDATE was a trustworthy cop, and tended to believe his statements and testimonies, instead of the defense. By putting on SANDY'S testimony, the prosecution covered up SALDATE'S lies and misrepresentations to make him look trustworthy. This proves that SALDATE'S tactics with lying and falsifying were instrumental for the prosecution to accomplish a trustworthy appearance. SANDRA had personal motives, which have already been described in detail.

As with the transcript of this tape we analyze the report in order to make you, the reader, realize the lies and allegations made, the points contained in here that conflict with the initial transcript and therefore are pure fabrication.

ON 6-30-90 AT APPROX. 1207 HRS (UTAH TIME), I CONTACTED SANDRA PICKINPAUGH IN HER HOME AT 755 RIVERVIEW DRIVE #4 IN GREEN RIVER WYOMING. THE PURPOSE OF MY CONTACT WAS TO INTERVIEW HER IN REGARDS TO THIS DEATH INVESTIGATION. THE FOLLOWING IS A PARAPHRASED ACCOUNT OF HER INTERVIEW.

SANDRA AND I DID NOT HAVE TO BE INTRODUCED BECAUSE WE HAD MET PREVIOUSLY IN PHOENIX DURING THE INITIAL REPORT. WE WENT INTO SANDRA'S KITCHEN AND SAT DOWN AT THE TABLE AND I EXPLAINED TO HER THAT I WANTED TO SPEAK WITH HER ABOUT HER SISTER DEBRA MILKE AND THE SITAUTION SURROUNDING THE DEATH OF HER NEPHEW CHRIS MILKE. SANDRA AGREED AND THEN GAVE ME THE FOLLOWING INFORMATION.
Discrepancy #1 : As stated with the analyzed version of the secret tape, SALDATE and SANDRA PICKINPAUGH had not met prior to this interrogation. SALDATE just repeats this allegation in this report.



SANDRA SAID THE LAST TIME SHE SPOKE TO HER SISTER WAS ON NOVEMBER 11, 1989. SHE SAID SHE CALLED HER TO WISH HER SON JASON A HAPPY BIRTHDAY. SANDRA SAID THIS WAS STRANGE BECAUSE USUALLY DEBBIE DIDN'T THINK OF ANYONE ELSE AND DIDN'T REALLY UNDERSTAND WHY DEBRA HAD CALLED. DURING THIS CONVERSATION, DEBRA TOLD HER THAT A JUDGE HAD DENIED JOINT CUSTODY TO MARK AT A RECENT COURT HEARING.
Discrepancy #2Sandra did not say it was strange that Debra had called to wish JASON a happy birthday. SALDATE already started here with his character assassination of Debra Milke.



I THEN ASKED SANDRA IF SHE COULD TELL ME ABOUT ANY OF DEBRA'S FRIENDS. SHE IMMEDIATELY RESPONDED THAT DEBRA DID NOT HAVE FRIENDS. SHE EXPLAINED THAT DEBRA WILL CALL UPON PEOPLE WHEN SHE NEEDS SOMETHING BUT THEY ARE NOT REALLY HER ACTUAL FRIENDS. SHE SAID THAT FOR THE MOST PART, SHE WAS GETTING JIM TO DO EVERYTHING FOR HER.
Discrepancy #3SALDATE dropped the entire part of the interrogation about SANDRA'S mother and their father, RICHARD SADEIK. SALDATE also twisted SANDRA'S statement. He did not ask SANDRA about her sister, but about Debra's position with JIM, when SANDY stated Debra did not have any friends. However, SALDATE dropped all the statements made of SANDRA, saying her sister Debra had a way with people. He obviously knew that would conflict with the picture he intended to create.



I THEN ASKED SANDRA IF SHE COULD DESCRIBE HER SISTER AND SHE SAID SHE COULD. SANDRA THEN SAID HER SISTER DEBRA WAS, IN HER WORDS, MATERIALISTIC, SELFISH, SELF-SEEKING , SELF-CENTERED, VAIN AND CONCEITED. SANDRA SAID THIS MAY SOUND AS IF SHE DID NOT LIKE HER SISTER, HOWEVER, THAT WAS NOT TRUE. SHE SAID SHE LOVES HER SISTER BUT THAT SHE HAS COME TO REALIZE WHAT HER SISTER ACTUALLY IS AND FOR THE MOST PART, SHE FEELS SORRY FOR HER.
Discrepancy #4SALDATE initially used a lie to accomplish this statement from Sandra like this [claiming he had been confirmed by other people she was materialistic...]. But SALDATE lied about this statement insofar that SANDY never said she felt sorry for the way her sister Debra is. SALDATE also never asked SANDRA to describe her sister; he preferred a chit-chat kind of talk.



I ASKED HER IF SHE COULD EXPLAIN AND SHE SAID HER SISTER DEBRA WAS AN EXPERT AT MANIPULATING PEOPLE.
Discrepancy #5: It was SALDATE who explained : "That's the kind of manipulation she does." And it's chronologically incorrect, since this point happened at a much later time in the interrogation.



SANDRA SAID THAT SHE WAS HER MAIN TARGET DURING THAT PERIOD OF TIME BECAUSE AS SANDRA DESCRIBED HERSELF, SHE WAS EASY.
Discrepancy #6Sandy did not say she was the main target, and she did also not say she was easy. SANDRA had described herself as rebellious and independent. SALDATE intended to make the jury believe Debra's sister was the nice and easy-going American girl next door.



SANDRA WENT ON TO SAY THAT SHE ON MANY OCCASIONS WOULD BE APPROACHED BY DEBRA AND THAT DEBRA WOULD BREAK DOWN AND TELL HER THAT SHE WANTED TO DO BETTER AND WANTED TO GET AWAY FROM MARK, HER HUSBAND. SANDRA SAID SHE WOULD USUALLY FALL FOR THIS AND AGREE WITH DEBRA THAT SHE SHOULD DO THESE THINGS.
Discrepancy #7: SANDRA did not say she fell for these things; she said : "... we would all coach her, you know, we'd all say, yes, stay out of his life..."



DEBRA WOULD THEN TURN IT AROUND AND THEN USE IT AGAINST HER AND AFTER SEVERAL WEEKS OF TAKING CARE OF CHRIS, SHE WOULD REALIZE THAT THE ONLY REASON SHE SAID THESE THINGS WAS BECAUSE SHE WANTED SOMEONE TO TAKE CARE OF CHRIS. SANDRA SAID THAT IT WOULD START BY DEBRA TELLING HER IF SHE WOULD JUST ONLY TAKE CARE OF CHRIS FOR 2 DAYS, SHE COULD PROBABLY GET HER HEAD TOGETHER, GET RID OF MARK AND DO BETTER FOR HERSELF. SANDRA SAID THAT AS SOON AS SHE BEGAN TO AGREE WITH HER, SANDRA SAID "BINGO", SHE WOULD BE CAUGHT IN THE TRAP, AND THAT 2 DAYS WOULD TURN INTO 2 MONTHS.
Discrepancy #8 : SANDRA never said anything like this. SALDATE picked up a lot of single statements and put them together, but all of these phrases were completely taken out of context. It's basically the same manipulative technique he used to write the alleged confession.
SANDRA did not say that she had to agree with Debra, rather "we all would coach her".



I THEN ASKED HER ABOUT THE TIME WHEN DEBRA WENT TO COLORADO PRESUMABLY TO GET HER ACT STRAIGHT. SANDRA JUST CHUCKLED AND SAID THAT WAS A JOKE.
Discrepancy #9: Just the opposite. SANDRA said "she was very sincere".



SHE SAID THAT SANDRA (should be : DEBRA) CONVINCED AN OLD BOYFRIEND TO GIVE HER MONEY BECAUSE SHE WAS GOING TO DIVORCE MARK AND GET HER LIFE STRAIGHT BUT INSTEAD SHE USED THE MONEY TO GO COLORADO TO VISIT A FAMILY FRIEND BY THE NAME OF DOROTHY MARKWELL. SHE SAID AT FIRST IT WAS SOMETHING THAT DEBRA SAID SHE NEEDED TO DO TO GET HER LIFE STRAIGHT AND AGAIN SHE BELIEVED HER. SANDRA SAID SHE WASN'T THERE MORE THAN 2 DAYS WHEN SHE MET WITH A GUY AND THAT DOROTHY CALLED HER AND SAID THAT DEBRA WAS STAYING WITH THIS GUY AND THAT SHE WAS HAVING TO TAKE CARE OF CHRIS. SHE SAID THAT DEBRA RETURNED FROM COLORADO A SHORT TIME LATER AND THAT SHE WAS TOLD THAT DEBRA WAS PREGNANT AND GOT AN ABORTION.
Discrepancy #10 : It's true that an abortion was an issue during the interrogation, but not in this context. It came in much later and is not a part of the transcript of this tape, therefore nothing we can compare 1-to-1.



SANDRA WENT ON TO SAY THAT HER SISTER IS A MASTER OF DECEPTION AND MANIPULATION AND THAT SHE HAS A CERTAIN WAY WITH PEOPLE. SHE SAID THAT DEBRA CAN MAKE ANYONE DO WHAT SHE WANTS THEM TO, EVEN THOUGH THEY MAY TRULY KNOW DEBRA. SANDRA THEN SAID "THERE IS NO LIMIT WHAT PERSON WOULD DO FOR DEBRA."
Discrepancy #11SALDATE dropped all statements SANDRA made pertaining to her sister being an intelligent and sane person, "... more sane than anybody..." SALDATE also lied about the term 'Master of deception'. It was him who had used this statement at very first. SALDATE also lied about "... there is no limit that a person would do for her...", since it was him who used the term "getting people to do anything for her" at first.



SANDRA THEN TOLD ME THAT THE PHONE CALL SHE RECEIVED ON THE 11TH, DEBRA TOLD HER THAT ERNIE, WHO WAS DEBRA'S BOYFRIEND AT THE TIME PROPOSED TO HER AND THAT THEY PLANNED TO GET MARRIED AS SOON AS ERNIE SPENT A LITTLE BIT MORE TIME WITH CHRIS AND GOT ADAPTED TO HIM. SANDRA SAID SHE KNEW THAT ERNIE AND DEBRA WERE DATING BUT THAT HE DID NOT APPEAR TO BE THE TYPE OF PERSON, EVEN THOUGH SHE THOUGHT HE WAS VERY NICE.
Discrepancy #12: The entire "marriage issue" was a fabricated thing (both Debra and ERNIE SWEAT testified several times their relationship was mere fun at that stage) and served as a motive to SALDATE and the prosecution. SANDRA said she met ERNIE SWEAT, Debra's then-boyfriend, once. She did not say "he did not appear the type of person" pertaining to the alleged marriage plans, just the opposite. She said about this : "Which was understandable to me..."



APPROXIMATELY 3 DAYS LATER, SHE SAID SHE RECEIVED A CALL FROM JIM STYERS AND DURING THE CONVERSATION WITH JIM, SHE TOLD HIM THAT DEBBIE HAD CALLED AND THAT SHE REALLY SOUNDED HAPPY. SANDRA SAID SHE WENT ON TO TELL JIM THAT SHE HAD HEARD THAT THE RELATIONSHIP WITH ERNIE AND DEBRA WAS GOING VERY WELL AND THAT THEY WERE POSSIBLY GOING TO GET MARRIED. SANDRA SAID THAT JIM IMMEDIATELY ASKED HER WHERE SHE HAD HEARD THIS IMFORMATION AND SHE TOLD HIM THAT DEBBIE HAD TOLD HER. JIM THEN TOLD HER THAT DEBBIE AND ERNIE WERE HAVING TROUBLE AND SAID SOMETHING TO THE EFFECT THAT DEBBIE MUST HAVE BEEN HALLUCINATING. HE THEN TOLD HER THAT DEBBIE HAD GIVEN ERNIE AN ULTIMATUM AND THAT THEY WERE HAVING PROBLEMS BECAUSE OF THAT. SANDRA SAID SHE IMMEDIATELY REALIZED THAT DEBBIE TOLD HER THESE THINGS BECAUSE THAT'S WHAT DEBBIE WANTED TO BELIEVE. SHE SAID THAT DEBBIE WAS THE MOST CONVINCING TO HERSELF.
Discrepancy #13SALDATE repeated an allegation that was obviously untrue when SANDRA claimed it. Initially she would say "You know, bickering back and forth over - I guess she proposed an ultimatum to him". SALDATE claims that an ultimatum was a fact, but that's another 'improved version'. No ultimatum has ever been proven or taken place at all, and SANDRA made it very clear that she was only guessing. After all, SANDRA had been living in another state for at least four months at the time the murder took place.
As far as 'hallucinating', SALDATE explicitly asked back and SANDRA corrected herself, saying "Well, it didn't come out exactly, you know, she's hallucinating." Therefore SALDATE twisted that statement again, claiming in his report JIM STYERS told SANDRA that Debbie was hallucinating.



SHE SAID THAT JIM THEN BEGAN TO COMPLAIN THAT HE WAS AFRAID THAT DEBBIE WAS GOING TO TAKE ADVANTAGE OF HIM AND THAT HE COULD ALREADY SEE THAT HE WAS GOING TO PROBABLY HAVE TO TAKE CARE OF CHRIS FOR THE MOST PART. SANDRA SAID SHE REMINDED JIM THAT SHE HAD WARNED HIM ABOUT THIS BEFORE HE LET HER MOVE IN.

A COUPLE OF DAYS LATER, JIM AGAIN CALLED AND TOLD HER "GUESS WHAT." JIM THEN WENT ON TO TELL HER THAT SHE WAS ALREADY DOING IT AND TAKING ADVANTAGE OF HIM. I THEN ASKED SANDRA WHY JIM WOULD LET HER DO THIS AND SANDRA REPLIED THAT SHE WAS SURE THAT DEBBIE WOULD PROBABLY LEAD HIM ON, TEASE HIM AND PURSUE INTIMATE THOUGHTS WITH HIM. SANDRA SAID SHE WAS SURE THAT DEBBIE WOULD NEVER HAD SLEPT WITH JIM BUT THEN SAID "I'M SURE SHE WOULD GIVE HIM ENOUGH FOOD FOR THOUGHT TO MAKE HIM DO ANYTHING FOR HER."
Discrepancy #14SALDATE did not ask SANDRA why JIM would let Debra do this. And he completely lied about SANDRA'S answer to that question, because SANDY explained that "JIM just did not have the ability - he did not have the strength to stand up for himself." It's obvious this allegation was made to make Debra appear a woman who would use her sexual attraction to get everything she wants.



I THEN ASKED SANDRA WHAT HER RELATIONSHIP WITH JIM WAS AND SHE SAID THEY WERE VERY, VERY CLOSE FRIENDS. SHE DESCRIBED JIM AS DOING ANYTHING FOR HER AND SHE SAID SHE WAS VERY COMFORTABLE AROUND JIM, SHE DID ADMIT THAT JIM AT ONE TIME HAD THOUGHT THAT THEY COULD BECOME ROMANTICALLY INVOLVED, HOWEVER, SHE IMMEDIATELY TOLD JIM THAT COULD NOT HAPPEN AND THAT THEY WOULD ONLY REMAIN FRIENDS. I THEN ASKED HER IF DEBRA WOULD HAVE BEEN AS HONEST TOWARDS JIM IF HE WOULD HAVE THOUGHT ABOUT BECOMING ROMANTICALLY INVOLVED WITH DEBRA. SANDRA THEN REPLIED THAT DEBRA WOULD ONLY USE THAT WEAKNESS IN JIM AND WOULD NEVER TELL HIM THAT SHE WOULD NEVER WANT TO BE INVOLVED WITH HIM ROMANTICALLY. SANDRA SAID SHE CAN'T BELIEVE THAT JIM WOULD HAVE FELL (sic) FOR THIS BECAUSE SHE TRIED TO EXPLAIN TO JIM ABOUT DEBRA BEFORE SHE LEFT. I THEN ASKED HER IF IT COULD BE LOVE ON JIM'S PART AND SHE SAID THAT'S THE ONLY THING SHE COULD THINK OF THAT WOULD BE DRIVING JIM.
Discrepancy #15SALDATE has never asked SANDRA if she thought that Debra would be honest with JIM STYERS, if he hoped to become romantically involved with her. SALDATE claimed "You have to love somebody a lot to do what he did. I mean, I don't know if it's mind control or if she has that strong of a (inaudible) but she has really controlled Jim" and SANDRA replied "Oh, yeah. That's not surprising. Jim is very easily controlled." The technique behind it is that SALDATE makes a statement, claiming Debra had been caught with this-and-that misdemeanor, and all SANDRA has to provide is an occasional "oh yeah". There is no easier way for SANDRA to get even with Debra, being at feud with her older sister on a private basis. But this entire issue came up much earlier in the interview, and is chronologically incorrect.



IN SEPTEMBER, SANDRA SAID SHE RECEIVED A CALL FROM DEBRA, ASKING HER IF SHE AND HER HUSBAND RON COULD TAKE CHRIS BECAUSE HER DAD DIDN'T UNDERSTAND AND THAT HE WAS BEING AN ASSHOLE AND WOULD NOT TAKE HIM. SHE SAID SHE TOLD DEBRA SHE DIDN'T REALLY KNOW AND WOULD HAVE TO TALK TO RON. DEBRA WENT ON TO TELL HER THAT SHE COULDN'T HANDLE CHRIS AND THAT HE WAS JUST A BRAT.
Discrepancy #16Sandra never cited her sister, saying her father wouldn't take Chris and that he was being an asshole. That statement referred to financial support only at that time : "When she called us she wanted more money. She says Dad's being an asshole and he doesn't understand..." Also, it was Sandy who said: "My dad, yeah, I'm the same way, I'm not cleaning up your messes." Sandra cited Debra that she (Debra) had talked to Mark, who didn't want Christopher to go with her father, but with Sandy. Never did Sandy say Debra called her up, asking whether she could take Chris. Sandy said "If mom is willing to pay for his plane fare out here when she comes then Ron and I would be willing to keep Christopher..."



SHE SAID HE WAS A PROBLEM AND THAT HE INTERFERED WITH HER WORK, HER SOCIAL LIFE AND HER BOYFRIEND ERNIE. SANDRA SAID SHE COULD NOT UNDERSTAND WHAT SHE MEANT BY THIS SINCE IT HAS BEEN HER UNDERSTANDING SINCE SHE LEFT THAT EVERYONE ELSE WAS TAKING CARE OF CHRIS AND THAT DEBRA WOULD DO VERY LITTLE.

DEBRA ALSO TOLD HER THAT ERNIE HAD GOTTEN OFFERED A JOB OUT OF STATE, POSSIBLY COLORADO, AND THAT ERNIE HAD INVITED HER TO GO WITH HIM. DEBRA SAID THAT ERNIE DIDN'T WANT TO TAKE CHRIS SO SHE NEEDED SOMEONE TO TAKE CARE OF HIM. SANDRA SAID SHE THEN ASKED DEBRA IF SHE WAS SURE IT WAS ERNIE AND NOT HER AND SANDRA SAID THAT DEBRA IMMEDIATELY HUNG UP THE PHONE.
Discrepancy #17: It was much earlier that SANDY stated that ERNIE had gotten offered a job. That's when SANDRA alleged about the ultimatum. Later on SANDY proposed referring to the Colorado plans : "I told her to go for it and she says well, I'm just worried about Christopher because Mark was out - I think in prison at that time - well, he left and she was having a hard time." SALDATE took all the statements out of proportion and made this statement up.
SANRA also never said 'Ernie didn't want to take Chris'. It was SALDATE who asked "Did she tell you that he was interfering with her social business ?" and SANDY replied : "... And that if she could just find a solution she and Ernie could be together."



APPROXIMATELY ONE WEEK LATER, DEERA AGAIN CALLED HER AND APOLOGIZED SHE TOLD HER THAT MARK HAD KIDNAPPED CHRIS EARLIER BUT THAT SHE HAD GOTTEN HIM BACK. SHE THEN TOLD HER THAT BECAUSE OF MARK'S ACTIONS, SHE DIDN'T THINK THAT CHRIS WAS SAFE ANYMORE. SANDRA THEN EXPLAINED THAT HER HUSBAND RON WAS LISTENING ON THE OTHER PHONE AND THAT HE WAS WHISPERING TO HER THAT DEBRA WAS AGAIN TRYING TO USE HER. HE TOLD HER THAT THE FIRST TIME SHE WANTED THEM TO TAKE CARE OF CHRIS, SHE TOLD HER NO, AND NOW SHE WAS USING MARK AND THE SAFETY OF CHRIS TO GET HER TO SAY YES. SANDRA SAID SHE TOLD DEBRA THAT SHE WOULD HAVE TO TALK TO HER HUSBAND RON ABOUT TAKING CHRIS AND DEBRA THEN BECAME VERY HAPPY AND THEY ENDED THEIR CONVERSATION.
Discrepancy #18: Never did SANDY say that Debra was using "Mark and the safety of Chris to get her to say yes". SANDRA said "... and called me a week later apologized and said Mark kidnapped Christopher and that she didn't feel Christopher was safe anymore."
SANDY did not explain that her husband RON was listening on the other phone. She said "And her mom was on the other phone..." and SALDATE completely fabricated his statement. The same with true pertaining to RON whispering to SANDRA. SANDY never said anything like this. All that SANDRA talked about was a visit of CHRSITOPHER to be with her son JASON.



WITHIN A WEEK, DEBRA AGAIN CALLED AND SANDRA 'SAID SHE TOLD DEBRA THAT SHE AND RON HAD TALKED ABOUT IT AND THEY HAD AGREED TO TAKE CHRIS BUT FOR ONLY 2 MONTHS. SHE SAID THEY TOLD DEBRA THEY COULD NOT AFFORD TO SEND FOR CHRIS BUT IF HER MOTHER WOULD AGREE TO PAY FOR THE AIRLINE TICKET FOR CHRIS, THAT CHRIS COULD SPEND SOME TIME WITH THEM. SANDRA SAID THAT DEBRA TOLD HER THAT IT WOULD ONLY BE FOR 2 MONTHS UNTIL SHE AND ERNIE GOT SETTLED AND WORKED THE PROBLEM OUT. SANDRA SAID SHE ENDED THE TELEPHONE CONVERSATION BELIEVING THAT HER MOTHER WOULD PAY CHRIS' AIRLINE TICKET.
Discrepancy #19: SANDY did not say 'they could not afford to send for Chris'. She said "If mom is willing to pay for his plane fare out (... ) I would be willing to keep Christopher...". She also never said Debra stated "it would be only for 2 months". SANDY made it clear that "... for no longer than two months...". SALDATE intended to accomplish the assumption that Debra had the planning on her part. But that's simply untrue.

At this point the tape recording and the original transcript of the interview with SANDRA PICKINPAUGH ends. It will remain a secret whether the rest of this report contains as many allegations, twisted statements and lies as this first part, but - as everybody will imagine - there is a high likeliness, it does. However, the reason this report is published here on this website is to explain to the reader that former Phoenix Police Detective ARMANDO SALDATE, JR. had a pattern of lying and fabricating statements that landed Debra Milke on death row, manipulated jury members and served the prosecution 'evidence' to win this case at any cost. It also led family members to believe their daughter had indeed confessed to a conspiracy to have her 4-year-old son, CHRISTOPHER CONAN MILKE, murdered. The outrage about such a heinous crime locally in Arizona is understandable, yet it can be proven without a doubt that the media and the public was led to believe a story that is full of allegations that were made up and falsified facts. Other than SALDATE's allegations no other evidence against Debra Milke ever materialized.

This page is also evidence that Debbie's sister SANDRA PICKINPAUGH was an unreliable and prejudiced witness, who used her initial testimony in this case to get even with her older sister. Decent police work and an accurate handling of this case through the prosecution should have excluded such demeanor completely.

SALDATE'S fabrications of allegations should have been uncovered by prosecutor NOEL LEVY in order to grant Debra Milke a fair trial. Nothing like this ever happened. MR. LEVY used SALDATE's tactics to accomplish a conviction. He must have had better access to the police records than Debra's weak public defender, therefore should have made sure SALDATE's report was accurate. LEVY did the opposite : by taking SANDRA PICKINPAUGH to the witness stand and having her confirm the truthfulness of SALDATE's report, he made it even worse. No matter how many witnesses would have been called... this internet page is hardcore evidence of at least 19 discrepancies on only four pages (of the report) and exposing the tactics of former Phoenix Police Detective ARMANDO SALDATE, JR., in order to tie Debra Milke to a crime she has nothing to do with.
